30-Year-Old Woman Receives Prison Sentence for Fabricating Rape Allegation, Legal Penalties Increased

A woman in her 30s has been sentenced to prison for falsely accusing her biological father of rape after he declined to provide her with financial support. He had previously funded her education abroad.

The Namyangju Branch of the Uijeongbu District Court's Criminal Division 1, under Presiding Judge Choi Chi-bong, recently sentenced the woman, referred to as A, to 10 months in prison. The charges included defamation, business obstruction, and insult.

A was tried for making 11 posts on an online forum between May and June last year, titled "I am a victim of familial sexual violence. Please look at this," which defamed her father, B.

In her posts, she falsely stated that she had been sexually assaulted by her father since she was four and that her mother had also experienced domestic and sexual violence. She claimed the issue was resolved with 30 million won in damages and called for severe punishment.

A also revealed B's real name and business details, reportedly causing difficulties in his business operations.


 


Furthermore, A is accused of posting six times alleging that B remarried a woman, C, with whom he had an affair.

In February 2021, A filed a lawsuit for damages related to sexual assault against B at the Incheon District Court but did not provide evidence of illegal conduct.

During the criminal trial, A maintained that her statements were true, but the court did not uphold her claims, referencing the lawsuit outcome. The court noted the absence of evidence supporting A's allegations of habitual sexual assault by B.

The court found A's claims to be false, citing that she had received financial assistance from B during her studies and after her return. The court noted that the rape accusation was made shortly after her request for substantial funds to open a cafe was denied.


The court stated that A disseminated false information due to dissatisfaction with the refusal of financial support, emphasizing that the reputations of the victims are irreparably damaged.


The court also elaborated on the sentencing, considering the high likelihood of reoffending, as A continued similar postings after the crime, and the victims' strong desire for severe punishment. These aspects were comprehensively evaluated in the sentencing decision.
